REGULATIONS FOR RESERVATION OF HOTEL ROOMS AND OTHER HOTEL SERVICES
AND STAY OF GUESTS AT THE ZAMKOWY MŁYN HOTEL *** Krapkowice

Entry

1. These regulations define the rules for the provision of Services by the Service Provider, the rights and obligations of the Service Provider and Service Recipients related to the provision of hotel Services and additional services, the rules for the protection of personal data of natural persons using them and the rules for excluding the Service Provider's liability for the provision of Services.
2. The Regulations have been placed by the Service Provider on the Service Provider's website in a manner that enables the acquisition, reproduction and recording of the content of the Regulations using the IT system used by the Service Recipient.

I. General provisions

1. The terms used in these Regulations mean:
and. ICT system – a set of cooperating IT devices
and software, ensuring processing and storage, as well as sending
and receiving data via telecommunications networks using a terminal device appropriate for a given type of network within the meaning of telecommunications law,
b. distance contract – a contract concluded with a consumer as part of an organised system of concluding distance contracts, without the simultaneous physical presence of the parties, with the exclusive use of one or more means of distance communication up to and including the moment of conclusion of the contract,
c. Electronic communication means – technical solutions, including ICT devices and software tools cooperating with them, enabling individual remote communication using data transmission between ICT systems, in particular electronic mail,
d. Service Provider – DELTA WGW Sp.j. ul. Młyńska 3, 47-300 Krapkowice, NIP: 199 003 96 96, owner of the Hotel Zamkowy Młyn Krapkowice
e. Service Recipient – an entity that is a natural person, a legal person or an organizational unit without legal personality, using the services of the Service Provider, the Service Recipient may also be a Guest,
f. Guest – a person using hotel or additional services offered by Hotel Zamkowy Młyn in Krapkowice. This person may also be a Service Recipient,
g. Registration form – an online form posted on the Service Provider’s website, used to register the Service User in the system,
h. Online booking – hotel services are booked in real time using the booking program available at www.zamkowymlyn.pl
and. Authorization Document – a document sent to the Service Recipient by the Service Provider in electronic form, specifying the detailed terms and conditions of the reservation, including: the length of stay, the amount due for the reserved stay, and the deadline for payment of the non-refundable prepayment (non-refundable deposit) for the stay at the Zamkowy Młyn Hotel. Acceptance of the authorization document occurs by the Service Recipient paying the Service Provider the amount indicated in the authorization document, at which point an agreement is concluded between the Service Recipient and the Service Provider for the provision of hotel services specified in the authorization document or additional services offered by the Service Provider.
2. Before using the services provided by the Service Provider, including using the website and the booking engine, the Service Recipient is obliged to read these Regulations and confirm that he or she accepts their terms.

II. How to make a reservation

1. In order to make a reservation online, via the IT system used by the Service Provider, it is necessary to use commonly used internet browsers.
2. Correct use of the services provided by the Service Provider via the ICT Service is possible after enabling the option of accepting cookies in the Internet browser used by the Service User and disabling the blocking of pop-up windows.
3. The Service Provider provides services to the Service User within the scope and under the conditions specified in these regulations.
4.  The Service Recipient undertakes to comply with these regulations.
5. The Service Provider reserves the right to carry out maintenance work on the IT system, which may cause temporary difficulties or prevent the Service Users from using the IT Service.
6. You can book your stay via:
andthe Hotel's website and the reservation program located on the Service Provider's website,
b. completing and signing the reservation form on the Hotel's website and sending it to the Hotel electronically,
c. placing an order for a stay at the Hotel in writing, by fax or electronically (e-mail),
d. making a reservation by phone,
e. personal, written confirmation of the reservation at the Hotel Reception, the so-called direct on-site reservation.
7. Reservation made in any of the above forms is tantamount to acceptance of the regulations.

III. Reservation Process

1. Online reservations are made by following the steps recommended by the automatic reservation system, completing the registration form and making the required payment.
2. The Service User is fully responsible for the consequences of providing incorrect data in the forms.
3. Prices displayed in the system are per room per hotel night or per guest night and include VAT. They may also include other services, as specified in the offer description. If the offer includes breakfast or other additional services, this information is included in the price description displayed in the system during the booking process. Any services not included in the order must be paid for on-site by the guest.
4. The unit of payment is the Polish zloty (PLN).
5. Payment is made by: credit card, bank transfer or postal order.
6.Settlements of transactions by credit card, BLIK and e-transfer are carried out via the Przelewy24.pl system
7.After selecting the payment method, the customer is redirected to the website of the appropriate bank or Przelewy24.pl system.

IV. Price for hotel services and additional services

The price list for accommodation services/rooms/stay packages at the Zamkowy Młyn Hotel is available on the website www.zamkowymlyn.pl, containing prices current on the date of the reservation and in the booking engine, also available on the website. Prices available on the website www.zamkowymlyn.pl are per room per night (booking engine) or per stay package (bed and breakfast). Prices may also include other services, specified in the offer description. If a given offer includes breakfast or other additional services, this information is provided in the price description displayed in the system during the booking process or in the Authorization Document sent to the Service User.

V. Making payments and issuing invoices

and. Payments are processed directly during the online booking process. Payment is required for confirmation, and the Service Recipient is notified of this. A reservation is considered complete only after a prepayment (deposit) has been made in the amount specified by the Service Provider. The prepayment amount is specified in the terms and conditions of the price offer.
b. The Service User who reserves a hotel room may pay the amount of the non-refundable prepayment (non-refundable deposit) referred to above in the form of a bank transfer, e-transfer, cash or by charging a credit card with the written consent of the Service User.
c. The non-refundable prepayment (non-refundable deposit) must be paid within the time specified in the Authorization Document.
d. Credit card authorization and payment settlement are handled by an external entity via a direct connection to the payment card processor's server.
e. The date of payment is considered to be the date on which the bank account specified on the website www.zamkowymlyn.pl is credited.
f. The Service Provider issues VAT invoices in accordance with the tax law provisions applicable in Poland.
g. In the case of in-person hotel room bookings directly from the hotel reception desk (so-called "direct bookings off the street"), the hotel reserves the right to directly collect a non-refundable deposit (or non-refundable prepayment) by charging the credit card upon check-in (in the guest's presence). If payment for the stay is to be made by credit card, the amount for the stay is paid in advance. In such cases, the "non-refundable prepayment" method also applies.
h. The billing period is seven days, meaning that any Service Recipient booking a stay longer than seven days is obligated to settle the amount due for the stay and services used within seven days of the commencement date. In justified cases, the Service Provider reserves the right to request an increase in the credit security amount on the Service Recipient's credit card or to settle the amount due for the Hotel stay at an earlier date.

VI. Confirmation of reservation

and. The reservation is deemed to be made when the online reservation system issues a confirmation number or when the guest receives a written confirmation of the reservation from the Hotel Reception, subject to the provisions of point VI bd below.
b. A reservation is considered complete when the Service Recipient pays the non-refundable prepayment (deposit) for the stay at the Hotel, in accordance with the declared duration of stay. Payment for the stay can be made in cash, by bank transfer, or by credit card debit with the Guest's consent.
c. Additionally, the online booking system automatically generates an e-mail confirmation sent to the Service Recipient's address provided in the form.
d. Failure to pay the non-refundable prepayment (non-refundable deposit) within the time specified in the Authorisation Document shall be deemed to be the Service Recipient’s withdrawal from the reservation of hotel services and shall result in the assumption that no agreement for the provision of hotel services has been effectively concluded between the parties.

VII. Conditions for changes and cancellations.

Cancellation Policy:

In the event of cancellation of the booked stay, the Guest will be charged a cancellation fee in the amount of the deposit paid.
A request to cancel a reservation should be made in writing, by fax or e-mail.
A Service User who shortens their stay when their stay is already in progress (i.e. when they have checked in at the Hotel) will be charged the full cost of the stay as declared when making the reservation.
The reservation cannot be modified in any way. In such a case, the Service Recipient will forfeit the deposit paid at the Service Provider's expense.

VIII. Conditions for approving and terminating contracts.

1. The hotel may refuse to provide the service without giving any reason.
2. The Service Recipient does not have the right to withdraw from the hotel service reservation agreement, in accordance with Article 38, point 12 of the Act of 30 May 2014 on consumer rights (Journal of Laws of 2014, item 827) ("Consumer Rights Act").

3. The hotel is not responsible for any interruptions in the supply of utilities from external suppliers. In such cases, the hotel will not refund all or any portion of the stay. Any claims regarding this matter should be submitted directly to the utility suppliers.

IX. Personal data protection

1. Data is collected via the website www.zamkowymlyn.pl by completing forms. The form contains required fields, which must be completed, and additional fields that can be completed by the Service User. The data provided in the form is processed for the purpose resulting from the function of the specific form.
2. The data is stored and processed by the Service Provider in accordance with the principles set out in the Personal Data Protection Act and the Act on the provision of electronic services.
3. The Service User has the right to access the content of his or her data and to correct, amend and delete it.
4. The provision of personal data by the Service User is entirely voluntary, however, refusal to provide it in certain cases may prevent the conclusion of the contract.
5. The Service Provider hereby informs that, pursuant to Article 18 of the Personal Data Protection Act, it has the right to process the Service Recipient's personal data in accordance with and to the extent specified in the aforementioned Act for purposes related to the online booking process. The Service Provider will receive this information through registration or logging into the system.
6. The personal data controller is: DELTA WGW Sp.j. ul. Młyńska 3, 47-300 Krapkowice, NIP: 199 003 96 96, operating the Hotel Zamkowy Młyn Krapkowice. The Service User has the right to access and correct their personal data.

X. Complaint procedure

1. Complaints may be filed within 14 days from the date on which the service was performed or was to be performed.
2. The complaint should:
and. be submitted to the registered office address of the Service Provider or by e-mail to the following address: recepcja@zamkowymlyn.pl
b. include the reason for submitting the complaint and specify the scope of the Service Recipient’s request,
c. be signed and contain current data of the Service Recipient.

XI. Transitional and Final Provisions

1. In matters not regulated by these regulations, the provisions of the Civil Code (Journal of Laws of 1964, No. 16, item 93, as amended), the Act on the provision of services by electronic means (Journal of Laws of 2002, No. 144, item 1204, as amended) and other provisions of generally applicable law shall apply.
2. The Service Provider reserves the right to make changes to these Regulations, provided that the version of the Regulations in force at the time the Guest places the order shall apply to reservations made before the amendment of the Regulations.
